What does MISA mean?

MISA is the short form for the Maintenance of Internal Security Act. It was a law passed in the year 1971 by the Indian Government and had fairly controversial enforcement. The law gave extensive powers to the Indian government headed by the then Prime Minister Indira Gandhi and other law enforcement agencies.

It provided superlative powers such as the seizure of property or other assets without a warrant, detention of individuals without preventive measures and many more.

History of the MISA

Enacted on the 2nd July 1971, the law replaced its successor, the Maintenance of Internal Security Ordinance which was enacted on 7th May 1971 by the President. The law and the legislation were seen as a means of disregarding civil rights and constitutional safeguards.

The law became more suppressing since there was a period of emergency during 1975-77 when hundreds of innocents were arrested and tortured.

Repealing the MISA

The law was placed in the 9th schedule of the Indian Constitution which made it immune from any review from the judiciary. But in 1977, the Janata Party led the government and appealed the law while the 44th amendment removed the law from Schedule 9.
