What does COTPA mean?

The Government of India, in 2003, constituted the Cigarettes and Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Act, also called COTPA.

This act was enacted by the Parliament of India on 9 April 2003 in Rajya Sabha and 30 April 2003 in Lok Sabha.

This act has the provisions for: 

• The sale and Smoking of Tobacco Products are restricted.
• Prohibits smoking in public.
• Separate smoking space in hotels with more than 30 rooms and restaurants with more than seating capacity for 30 people.
• Tobacco products are not to be sold to people under 18 years.
• Tobacco products are not to be sold within 100 yards of any educational institution.
• Violation of the above can lead to a penalty of ₹200.
• Promotion or Advertisements of Cigarettes and Tobacco products are restricted.
• Advertisement of tobacco products by the media is prohibited.
• Distributing pamphlets, documenting, or selling videos that promote cigarettes and tobacco products is prohibited.
• Advertisement is allowed only on the packets of tobacco products and at the entrance of shops where the products are being sold.
• Violation of the above for the first time can lead to a fine of ₹1000 and/or up-to five years ofimprisonment.
• Packaging of Cigarettes and tobacco products are restricted.
• There must be a warning with skulls and crossbones along with other warning signs on every packet of cigarette.
• There must be a detail of nicotine and tar content with the maximum permissible limit on the packet with a warning SMOKING KILLS, and TOBACCO CAUSES MOUTH CANCER in Hindi and English.
• Searching and Seizing Tobacco Products.

Police officers with a rank of Sub Inspector or any officer of State Food and Drug Administration or any officer holding the same level of position are authorized by either State or Central government to search and seize operations.
